Terms and privacy
Two documents. The terms of use are the agreement between us; the privacy notice says what we hold about you and why.
Benchmark — Terms of Use
Priory Walk Project Management Limited
Version 1.0 · Draft of 26 September 2026 · Not yet reviewed by a solicitor
1. Who we are, and what these terms are
1.1 Benchmark is operated by Priory Walk Project Management Limited ("we", "us", "our"), a company registered in England and Wales (company number 14582132), whose registered office is at Elsley Court, 20-22 Great Titchfield Street, London, W1W 8BE, United Kingdom.
1.2 These terms are a contract between us and the organisation whose representative opens an account ("you"). They govern your use of the Benchmark portal at benchmark.priory-walk.co.uk and everything in it (the "Portal").
1.3 Benchmark is for business users only. It is not offered to consumers, and you confirm that you are using it in the course of a business.
1.4 By setting up an account you accept these terms. If you do not accept them, do not set up an account.
1.5 A separate Privacy Notice explains what personal information we hold, why, and what rights you have in it. It forms part of your agreement with us.
2. Some words we use
| Term | Meaning |
|---|---|
| Your Documents | Anything you upload to the Portal — priced quotations, tenders, schedules, drawings, and anything else. |
| Extracted Data | The pricing information we read out of Your Documents: the item description, the unit, the quantity, the rate, the kind of work, whether the rate was stated or derived, and the quarter in which it was priced. |
| Identifying Details | Your company name, your client's name, the project name and address, the exact date, totals, the source file itself, and any free text naming a party. |
| The Benchmark Database | The pooled, anonymised collection of Extracted Data contributed by all users, and anything derived from it. |
| Your Area | The private part of the Portal holding Your Documents and your own records. |
3. Your account
3.1 We issue accounts by invitation. An invitation is bound to one email address, may be used once, and expires after thirty days.
3.2 You are responsible for everything done through your account, for keeping your password confidential, and for telling us promptly if you believe someone else has obtained access.
3.3 You must give accurate account information and keep it up to date.
3.4 Your account is for your organisation. You may allow your own staff to use it. You may not give access to anyone outside your organisation, or share your credentials.
4. What the Portal does — and what it does not
4.1 The Portal reads priced documents you upload and produces comparisons, analyses and other outputs from them. Where the Benchmark Database holds enough information, it may also show you ranges of prices contributed by others.
4.2 The Portal provides information, not advice. It is a tool for your own professional use. It does not provide quantity surveying, cost consultancy, valuation, legal or any other professional services to you, and we are not acting as your adviser in operating it.
4.3 You remain responsible for your own professional judgement. Any figure, comparison, range or observation the Portal produces must be checked by you before you rely on it or pass it to anyone else.
4.4 Outputs are produced by automated reading of documents, including by artificial intelligence. Automated reading makes mistakes. We do not warrant that any output is complete, accurate, or fit for any particular purpose.
4.5 Some parts of the Portal are described as in development. They are not available, and nothing in the Portal is a commitment to build them.
5. What you upload
5.1 You confirm, each time you upload, that you are entitled to do so. Specifically, that:
(a) you own Your Documents or have the rights necessary to upload them and to allow us to use them as these terms describe;
(b) uploading them, and allowing the Extracted Data to be contributed to the Benchmark Database, does not breach any obligation of confidence, non-disclosure agreement, contract or duty you owe to anyone; and
(c) where Your Documents contain information belonging to or about a third party — including quotations you have received from others — you have the right to share that information with us for these purposes.
5.2 This matters, so we say it plainly. Much of what a main contractor uploads will be pricing received from subcontractors. Deciding whether you may share that is your decision and not ours, and we rely on you having made it.
5.3 You must not upload anything unlawful, anything containing malicious code, or anything you have obtained improperly.
5.4 You will indemnify us against any claim, loss, cost or liability we suffer arising from a breach of clause 5.1 or 5.3 — that is, if someone brings a claim against us because you uploaded something you were not entitled to upload, you will cover our losses.
6. Contribution to the Benchmark Database
6.1 When you upload a document, the Extracted Data from it is contributed to the Benchmark Database. You agree to this when you set up your account, and it is stated on the sign-up screen.
6.2 Identifying Details are removed before anything is contributed. They stay in Your Area and do not enter the Benchmark Database.
6.3 Your account is identified inside our systems by a code, not by your name. The list matching codes to companies is held separately from the Benchmark Database, and access to it is restricted and recorded.
6.4 You grant us a licence over the Extracted Data: a worldwide, royalty-free, perpetual, irrevocable, transferable and sub-licensable licence to use, store, reproduce, adapt, combine and analyse it, to include it in the Benchmark Database, and to produce and publish aggregated outputs from it.
6.5 What we will not do. We will not show any other user Your Documents, your Identifying Details, or a single rate attributable to you. What other users may see is aggregated information drawn from more than one contributor.
6.6 A disclosure we want you to read rather than discover. The Benchmark Database is available to other subscribers, including firms who may be bidding the same work as you. Contributed pricing forms part of aggregated ranges that such a firm may see. We do not show them your figures, but we are not able to guarantee that aggregated information is of no use to a competitor.
6.7 Anonymisation is not a guarantee that you cannot be identified. We remove Identifying Details and we aggregate. In a trade served by a small number of firms, someone familiar with the market may nonetheless form a view about where a figure came from. We tell you this because it is true, not because we expect it to happen.
6.8 We may use the Extracted Data and the Benchmark Database for our own purposes, including improving the Portal, producing market analysis, and providing services to our own clients — always in aggregated form and never in a way that attributes a figure to you.
7. Removing a document, and what that does
7.1 For fourteen days after you upload a document, you may remove it yourself from within the Portal.
7.2 After fourteen days, you may ask us to remove it, and we will do so within thirty days of your request. Requests go to mail@priory-walk.co.uk.
7.3 Removing a document removes it from Your Area and stops any further use of the Extracted Data taken from it.
7.4 What has already been published stays published. A range that has already appeared in a report, an export or another user's screen cannot be recalled, and outputs already produced are not altered or withdrawn. Removal stops future use; it does not rewrite the past.
7.5 We may retain a record that a document existed and was removed, and any copy we are required to keep by law, but we will not use it.
8. Your Area
8.1 Your Documents, and the records you build from them, are yours. They are not shown to other users.
8.2 Your Area is separated from other users' by the design of the software rather than by separate hardware. This is ordinary practice and we mention it so that you know what the separation is.
8.3 If your account ends, clause 15 says what happens to Your Documents.
9. Where your information is held and read
9.1 Your Documents and the Benchmark Database are stored in the United Kingdom.
9.2 Your Documents are read by an artificial intelligence service operated by Anthropic, which operates from the United States. There is no United Kingdom or European option for that service. Content sent to it is not used to train its models, and it is deleted from that service within thirty days.
9.3 Email we send you is handled by a mail provider that stores message content outside the United Kingdom. We therefore never put a rate, a figure, a document name, a project name or another party's name in an email — our messages carry a sentence and a link, and nothing else.
9.4 The Privacy Notice sets out our suppliers and the safeguards that apply.
10. Ownership
10.1 You keep ownership of Your Documents.
10.2 We own the Benchmark Database, including the selection and arrangement of its contents and any database right in it, and everything we derive from it.
10.3 We own the Portal, its software, and everything in it other than Your Documents.
10.4 You may use outputs the Portal produces for you in your own business, including in documents you issue to your own clients. You may not resell them, publish them as a data product, or use them to build a competing database.
11. This is a beta
11.1 Benchmark is being tested. It is provided as it is, without any service level.
11.2 We may change it, suspend it, or stop it altogether, at any time and without notice.
11.3 Features may be added, altered or removed. Data may be lost. Keep your own copies of anything you cannot afford to lose.
11.4 Use of the Portal is currently free of charge. If we introduce charges we will tell you before any charge applies, and you may close your account instead.
12. Limits on our liability
12.1 Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.
12.2 Subject to clause 12.1, we are not liable for:
(a) any loss of profit, revenue, business, contracts, anticipated savings, goodwill or reputation; (b) any loss arising from your reliance on an output without checking it; (c) any loss of or corruption of data; or (d) any indirect or consequential loss.
12.3 Subject to clause 12.1, our total liability to you for everything arising under or in connection with these terms is limited to £1,000 (one thousand pounds).
12.4 These limits reflect that the Portal is provided free of charge, during a test, as information rather than advice, and that you are a business making your own professional judgements.
13. Suspension and ending the agreement
13.1 You may close your account at any time by telling us.
13.2 We may suspend or close your account if you breach these terms, if we reasonably suspect misuse, or if we stop operating the Portal.
13.3 When your account ends: Your Documents are deleted within ninety days, or sooner if you ask. Clause 7 governs anything already contributed — ending your account does not by itself withdraw contributed data, and does not recall anything already published.
13.4 We will not make continued membership a condition of removal. You may ask for your data to be removed whether or not you remain a user.
13.5 Clauses 5.4, 6.4, 6.8, 7.4, 10, 12 and 16 survive the end of this agreement.
14. If something goes wrong
14.1 Tell us. mail@priory-walk.co.uk. We would rather hear about a problem than read about it.
14.2 We aim to acknowledge any complaint within five working days.
15. Changes to these terms
15.1 We may change these terms. If we do, we will tell you and publish the new version in the Portal.
15.2 Each version is numbered and dated, and we record which version you accepted and when. Changes apply from the date we tell you, and do not apply retrospectively to anything already contributed.
15.3 If you do not accept a change, you may close your account.
16. General
16.1 Confidentiality. Each of us will keep the other's confidential information confidential and use it only for the purposes of this agreement.
16.2 Assignment. You may not transfer your rights under these terms without our consent. We may transfer ours to a company that acquires our business, on notice to you.
16.3 Third parties. Nobody other than you and us has any right to enforce these terms.
16.4 Entire agreement. These terms and the Privacy Notice are the whole of what is agreed between us about the Portal, and replace anything said or written before. Neither of us relies on any statement not set out in them. This does not limit liability for fraud.
16.5 Waiver. If we do not enforce a term, that does not mean we give it up.
16.6 Severance. If any part of these terms is unenforceable, the rest continues to apply.
16.7 Notices. We will write to the email address on your account. You should write to mail@priory-walk.co.uk.
16.8 Force majeure. Neither of us is liable for a failure caused by something outside our reasonable control.
17. Law
17.1 These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.

Benchmark — Privacy Notice
Priory Walk Project Management Limited
Version 1.0 · Draft of 26 September 2026 · Not yet reviewed by a solicitor
1. Who is responsible for your information
Priory Walk Project Management Limited (company number 14582132, registered office Elsley Court, 20-22 Great Titchfield Street, London, W1W 8BE, United Kingdom) is the controller of the personal information described here. That means we decide what is held and why.
Questions, requests and complaints: mail@priory-walk.co.uk.
2. Benchmark is a business tool, and most of what it holds is not personal information
Benchmark holds construction pricing: items, units, quantities, rates, and the kind of work. Pricing data about a company is not personal information.
Three things in it may be:
ACCOUNT INFORMATION the name and work email address of the person who
opens and uses an account
WHAT IS INSIDE A an uploaded quotation may name individuals - a
DOCUMENT contact at a supplier, a signatory, a person's name
in a trading name such as "J. Smith Joinery"
HOW THE PORTAL IS USED sign-ins, uploads, downloads, and the records we keep
of who did what and when3. What we hold, why, and on what basis
| What | Why | Lawful basis |
|---|---|---|
| Name and work email address | To create and run your account, to sign you in, to write to you about the service | Performance of a contract |
| Records of sign-ins, uploads and downloads | To operate the service, to investigate problems, to keep the service secure, to control cost | Our legitimate interests in running a service securely |
| Individuals named inside uploaded documents | Because they are part of a document you chose to upload; we do not seek them out or use them to contact anybody | Our legitimate interests in providing the service you asked for |
| The record of which version of the Terms you accepted, and when | To be able to show what was agreed | Legal obligation and legitimate interests |
| Correspondence with you | To answer you and keep a record | Legitimate interests |
We do not use your information for marketing to anyone else, and we do not sell it.
4. Information inside documents you upload
You decide what you upload. If a document names individuals, we hold those names as part of the document.
We do not extract them, index them, or use them to contact anyone. Names and other identifying details are removed from the pricing data before it enters the shared Benchmark Database, so they do not travel with a rate.
If you are uploading documents containing other people's information, it is for you to be satisfied that you may share them. The Terms of Use say so, and we rely on it.
5. Who else handles it
We use these suppliers. Each is bound by a contract that restricts what they may do with the information.
| Supplier | What they do | Where |
|---|---|---|
| Supabase | Holds the database and runs account sign-in | United Kingdom (London region) |
| Vercel | Serves the website | Distributed; the database it reads is in the United Kingdom |
| Google Cloud | Runs the process that reads documents | United Kingdom (London region) |
| Anthropic | The artificial intelligence service that reads the text of documents | United States |
| Resend | Sends our email | United States |
No other person or company is given access.
6. Information going outside the United Kingdom
Two of our suppliers operate from the United States.
Anthropic, the service that reads documents. There is no United Kingdom or European option for it. Content sent to it is not used to train its models and is deleted within thirty days.
Resend, which sends our email. Because message content is stored outside the United Kingdom, our emails never contain a rate, a figure, a document name, a project name or another party's name. They carry a sentence and a link.
Transfers to the United States are made under the safeguards United Kingdom law provides for them — standard contractual terms with the supplier, together with the UK addendum. Copies are available on request.
7. How long we keep things
YOUR ACCOUNT while it is open, and 90 days after it closes
DOCUMENTS YOU UPLOAD until you remove them, or 90 days after your
account closes. ** The original is the referee
if an extracted figure is ever disputed **
CONTRIBUTED PRICING DATA indefinitely, in anonymised form, as part of the
Benchmark Database. Removing a document stops
further use of its data - see the Terms, clause 7
RECORDS OF USE 24 months
CORRESPONDENCE 6 years
THE RECORD OF WHAT YOU for as long as we hold the contributed data
AGREED TO8. How it is protected
- Access requires an invitation, a password and a confirmed email address.
- Each account's documents are separated from every other account's, and the separation is tested.
- The list matching account codes to company names is held apart from the pricing data, access is restricted, and access is recorded.
- The database is backed up daily.
- Information is encrypted in transit and at rest by our suppliers.
No system is perfectly secure, and we would rather say so than imply otherwise.
9. Your rights
You may ask us to:
- give you a copy of the personal information we hold about you;
- correct it, if it is wrong;
- delete it, in the circumstances the law provides;
- restrict or object to our use of it, where our basis is legitimate interests;
- provide it in a portable form, where the law provides for that.
Write to mail@priory-walk.co.uk. We will respond within one month.
Removing uploaded documents is separate and simpler: you can do it yourself for fourteen days, and by asking us after that. The Terms, clause 7, explains what removal does and does not undo.
10. Complaints
If we have not put something right, you may complain to the Information Commissioner's Office — ico.org.uk, 0303 123 1113. We would rather you came to us first.
11. Changes
We will publish any new version here, numbered and dated, and tell you if the change is significant.
